I Z V E Š T A J S A O K R U G L O G S T O L A:
OTPUŠTANJA RADNIKA IZ JAVNIH KOMUNALNIH PREDUZEĆA
- NADLEŽNOST DRŽAVE ILI LOKALNE UPRAVE

Okrugli sto je organizovan sa ciljem da podstakne socijalni dijalog i diskusiju povodom donošenja Zakona o određivanju maksimalnog broja zaposlenih u lokalnim samoupravama. Okruglom stolu su prisustvovali predstavnici rukovodstva „UGS „Nezavisnost“, članovi Predsedništva Granskog sindikata saobraćajnih i komunalnih delatnosti „Nezavisnost“, predstavnici Ministarstava rada i socijalne politike R. Srbije; Swiss Labour Assistance; Progetto Svillupo; mediji; kao i predstavnici nekoliko lokalnih samouprava i direktora javnih komunalnih preduzeća (Beograd, Kragujevac, Zaječar, Kragujevac, Petrovac na Mlavi, Pančevo...) i eksperti za ovu oblast. Trebaju li zaposleni u javnim komunalnim preduzećima da imaju isti tretman kao i zaposleni u administraciji prilikom utvrđivanja viškova? Kako to da je Vlada nadležna za utvrđivanje viškova zaposlenih u ovim preduzećima, a nije za potpisivanje posebnog kolektivnog ugovora koji bi se na njih odnosio? Zašto se izbegava socijalni dijalog i veće uključivanje sindikata u rešavanje ovog problema? Da li je Vlada zaboravila da samo oporezivanje rada na crno potencijalno može dati mnogo veće efekte za budžet nego otpuštanja zaposlenih? Da li ima i drugih područja u funkcionisanju javnih komunalnih preduzeća gde su potrebni „duboki rezovi“?... samo su neka od pitanja na koja su učesnici pokušali da daju odgovore.
Organizovanja Okruglog stola je prema oceni učesnika ispunilo očekivanja. Javnost je upoznata sa stavovima sindikata „Nezavisnost“, a zaključci koji su na njemu usvojeni upućeni su Vladi R. Srbije, svim resornim ministarstvima, Socijalno-ekonomskom savetu R. Srbije, lokalnim samoupravama i lokalnim Socijalno-ekonomskim savetima i direktorima javnih komunalnih preduzeća i svim medijskim kućama. Među ključnim zaključcima su:
- Neprihvatljivo je da se Zakonom o određivanju maksimalnog broja zaposlenih u lokalnoj administraciji zaposleni u javnim komunalnim preduzećima poistovećuju, svrstavaju i izjednačavaju sa zaposlenima u administraciji lokalne samouprave.
- GS JSKD „Nezavisnost“ zahteva da se na osnovu Zakona o komunalnim delatnostima, Zakona o javnim preduzećima, kao zakonima lex specialis za komunalnu delatnost, i Zakona o radu, prava, obaveze i odgovornosti zaposlenih u ovom sektoru najpre regulišu Posebnim kolektivnim ugovorom za sva javna komunalna preduzeća, a onda i kolektivnim ugovorima kod poslodavaca. Ovo, pre svega, podrazumeva što hitnije identifikovanje partnera sa kojim sindikati mogu pregovarati oko zaključivanja navedenog kolektivnog ugovora, jer višegodišnji napori sindikata da se to desi nisu dali rezultat – Vlada R. Srbije sebe ne smatra nadležnom, resorna ministarstva takođe.
- Prekomerna i neproduktivna zapošljavanja u komunalnim preduzećima partijskih kadrova u administraciji rezultat su raznoraznih principijelno-neprincipijelnih politika lokalnih političkih lidera i direktora ovih preduzeća. Sa druge strane u komunalnim sistemima imamo stalno otvorene konkurse za prijem proizvodnih radnika. Zbog toga, utvrđenim i propisanim kriterijumima treba, pre svega, odrediti obim poslova – planova rada, a na osnovu tako utvrđenih procena kroz planove i programe rada doneti akte o sistematizaciji poslova i zadataka i odrediti broj izvršilaca poslova. GS JSKD „Nezavisnost“ je spreman da učestvuje u svim fazama ovakvog procesa.
- GS JSKD „Nezavisnost“ zahteva uspostavljanje pravog suštinskog socijalnog dijaloga na svim nivoima vlasti, kako bi se na pravi način rešavali problemi u javnim komunalnim preduzećima. Ukoliko se ostane na proklamovanim i najvaljenim merama i Vlada ne bude imala razumevanja za napred iznete zahteve, ovaj sindikat će biti prinuđen da pokrene sve vidove sindikalne borbe u cilju zaštite zaposlenih u ovim preduzećima, ali i građana, privrede i vanprivrede – korisnika njihovih proizvoda i usluga.

DISMISSAL OF EMPLOYEES FROM PUBLIC UTILITY COMPANIES
– RESPONSIBILITY OF THE STATE OR LOCAL SELF-GOVERNMENT

The round table was organised with the aim of encouraging social dialogue and discussion prompted by the adoption of the Law on determination of maximum number of employees in local self-governments. The round table was attended by representatives of TUC “Nezavisnost” leadership, members of the presidency of the “Nezavisnost” Public Transport and Utility Services Union (GS JSKD), representatives of the Ministry of Labour and Social Policy of Serbia; Swiss Labour Assistance; Progetto Svillupo; the media; as well as representatives of several local self-governments and directors of public utility service companies (Beograd, Kragujevac, Zaječar, Petrovac na Mlavi, Pančevo…) and experts in this subject-matter. Should employees in public utility companies have the same treatment as employees in administration when redundancies are determined? How come the Government is in charge of determining redundancies in these companies, but is not in charge of signing a branch collective agreement that would refer to the same companies? Why are social dialogue and greater involvement of trade unions in dealing with this problem being avoided? Has the Government forgotten that taxation of unreported work can potentially produce much greater effects for the budget than dismissal of employees? Are there other areas in the operation of public utility services where “radical moves” are necessary? These were some of the questions to which participants tried to provide answers.
According to participants' opinion, the Round Table fulfilled their expectations. The public became informed of the “Nezavisnost” trade union’s positions, while conclusions adopted have been forwarded to the Government of Serbia, all competent ministries, Social and Economic Council of Serbia, local self-governments and local social and economic councils, as well as to directors of public utility companies and all media houses. Some of the main conclusions include:
- Equating and treating identically employees in public utility companies as employees in administration of local self-governments, as provided for by the Law on Determination of Maximum Number of Employees in Local Self-Governments is unacceptable.
- GS JSKD “Nezavisnost” requests that pursuant to the Law on Public Utility Activities, Law on Public Companies, as well as by lex specialis laws for public utilities, and the Labour Law, the rights, obligations and responsibilities in this sectors be first regulated by a Branch Collective Agreement for all public utility companies, and then by company collective agreements. This primarily implies urgent identification of partners with whom trade unions can bargain over conclusion of the mentioned collective agreement, because many years of efforts of the trade union to accomplish this have remained futile – the Government of Serbia does not consider itself competent, the competent ministries either.
- Excessive and unproductive employment in administration of public utility companies of partisan staff is the result of various (un)principled policies of local political leaders and directors of these companies. On the other hand, public utilities continuously have vacancies for productive workers. Therefore, the first step should be to determine, according to defined and prescribed criteria, the volume of work – operating plans, and then, on the basis of such assessment, prepare job classifications and determine the number of operators for each job. GS JSKD “Nezavisnost” is willing to take part in all phases of such a process.
- GS JSKD “Nezavisnost” requests establishment of authentic social dialogue at all levels of government, so that problems in public utility companies could be solved properly. If the Government abides by its intended and proclaimed measures and shows no understanding for the mentioned requests, this trade union would have to resort to all forms of industrial action in the aim of protecting both employees in these companies, and also citizens, economy and non-economic activities – users of their products and services.
